Attorney Jason P. Sultzer Files Class Action Lawsuit Against Several Universities

The world turned upside down in 2020, and many students, faculty, and staff members across the U.S. are still coping with the fallout. Due to the COVID-19 pandemic, 1,300 colleges in every state closed their doors. As a result, over 44% of these institutions developed online instruction programs, and classes went from in-person to Zoom in a matter of months.

Millions of Americans have lost their jobs, homes, and lives to the Coronavirus, and hard times are still ahead. College seniors lost their opportunity to attend graduation and move on to internships and jobs. However, while the whole world stood still, college tuition offices were busier than ever.

While it’s understandable that colleges would need to adjust to the COVID-19 craziness, many institutions went far and beyond to collect their dues. Both KSU and SWRU failed to take their students’ financial burdens at face value and charged in-person tuition for virtual classes. In essence, they not only failed to provide the level of education they promised, but they also failed to be ethical in how they charged students for their education.

First Rate? Yeah, Right.

The basis of the lawsuits against KSU and CWRU point out that students attend these universities to benefit from the wealth of knowledge and quality of instruction the institutions have to offer. They sign an agreement and go through the proper channels to secure their spot in an increasingly competitive climate with the hope that it will all be worth it when they get their degree.

However, when these universities made the switch from in-person to online instruction, many students found the new format lacking.

“[Students] have paid for tuition for a first-rate education and an on-campus, in-person educational experience with all the appurtenant benefits offered by a first-rate university,” says the lawsuit filed by Attorney Sultzer.

Regardless of the drop in quality and instruction, KSU and CWRU still charged students for in-person classes despite the switch to online learning. One student, Daniel Lozada, says CWRU charged him more than $26,000 in tuition in fees – and he’s not alone.

The lawsuits against these universities point to unjust enrichment for sub-par instruction. Attorney Sultzer has filed a class-action lawsuit on behalf of other students attending CWRU and KSU as well. In total, Attorney Sultzer is a part of over 60 similar cases across the nation as students take action against unfair tuition and charges.
