Plaintiffs across the nation have banned together to file class action lawsuits against four major baby food manufacturers: Gerber Products Co., Plum Public Benefit Corp., Nurture Inc., and Hain Celestial Group Inc. The lawsuits claim that toxic metals such as arsenic, lead, cadmium and mercury were found in baby foods. It further alleges that the companies were aware and hid this information from consumers. This accusation falls under the standards of a product defect lawsuit, as the baby foods were allegedly mislabeled.
On March 13, 2021, Judge Joanna Seybert consolidated the 13 Hain lawsuits, represented by plaintiff Nicole Stewart. The other companies were excluded after claiming they were not affiliated with Hain, so they should be able to handle their suits separately.
