The Sultzer Law Group Obtains Another Victory on Behalf of College Students Fighting for Tuition Refunds

During the COVID-19 pandemic, many higher education institutions closed their doors to in-person learning to manage the spread of the virus. This forced many students to continue learning at home from their laptops instead of in classrooms. Although the need to shut down campuses was warranted due to the greater public health risk concerns, universities took advantage of students by collecting full tuition costs despite closing their campuses. Our latest victory in this arena came against Emerson College, which kept students’ full tuition for the Spring 2020 semester without providing in-person learning.

In denying Emerson College’s Motion to Dismiss, the Court ruled, in relevant part, that “the court cannot, as a matter of law, say that no student could have reasonably expected that paying the tuition charged for the Spring semester of 2020 and registering for on-campus courses would entitle them to in-person instruction.”
