Sultzer & Lipari, PLLC, scored a significant legal victory by defeating the motion to dismiss in a pivotal consumer protection case, Hernandez and Catalano v. POM Wonderful LLC, in the United States District Court for the Southern District of New York.
The Court upheld claims brought under the New York General Business Law Sections 349 and 450 and allegations of negligence per se related to the presence of PFAS—dangerous synthetic chemicals—in POM Wonderful’s products, paving the way for consumers to pursue their case against misleading health and marketing claims. The firm’s commitment to holding corporations accountable for deceptive practices was instrumental in achieving this outcome, ensuring that businesses adhere to truthfulness in their product representations.
“We are proud to represent consumers in this landmark case and to advance critical issues of public health, consumer rights, and corporate transparency,” said Jason Sultzer.
This ruling marks a major step forward in the fight to protect consumer interests from the dangers of PFAS and other “forever chemicals,” with Sultzer & Lipari continuing to lead the charge.
