About
Scott has 25+ years of substantial experience advocating for his clients in a variety of high-stakes, complex litigation matters, including class and collective actions involving fraud and breach of contract actions, alleged violations of RICO, and various federal and state consumer protection laws. Scott also represents parties in breach of fiduciary duty and partnership actions, fiduciaries and beneficiaries in sophisticated trusts and estates litigation and defending large, international law firms and their lawyers in professional liability claims. Scott has extensive experience representing companies in responding to and defending against investigations and lawsuits by Attorneys General.
Prior to joining Sultzer & Lipari, PLLC, Scott worked at Elman Freiberg PLLC, Moses & Singer LLP (for almost two decades), and before that, at Hodgson Russ LLP, and Wilson Elser, representing parties in complex litigations.
Among other civil volunteer responsibilities, Scott has served as President of the Board of Education of the Scarsdale Union Free School District, and as a member of the Board of Directors of the Crohn's & Colitis Foundation - Fairfield/Westchester Chapter, Westchester Reform Temple, Zeta Beta Tau Fraternity, Scarsdale Schools Education Foundation, and Scarsdale Youth Soccer Club.
Prior to attending law school, Scott worked in Washington, D.C, in the legislative offices of Congressman Gary Ackerman.

Represented a closely held jewelry company in the defense of a lawsuit concerning claims of an oral agreement of a partnership agreement, and successfully resolved the matter without the need for a trial.
Convinced an arbitration panel to dismiss all claims for compensatory and punitive damages for alleged fraud by a leading luxury real estate auction company.
Successful defense of numerous state and federal class actions in New York, California, Illinois, and Louisiana against a leading equipment finance company specializing in the origination and servicing of micro-ticket leases. For example, represented the same company and its officers in a class action in Supreme Court, New York County, the Appellate Division - First Department, and the New York Court of Appeals concerning claims for breach of contract due to alleged unauthorized fees and overcharges. Represented the same company in responding to investigations by numerous Attorneys General.
Obtained transfer of venue from California and then early dismissal of a putative federal class in the Southern District of New York of an action alleging usury and violations of consumer protection laws against a financing company specializing in the purchase of future credit card receivables.
Represented an alternative investment advisory firm in an arbitration for the breach of a securities purchase agreement, and successfully resolved the matter without the need for a hearing.
Successfully prosecuted and defended multiple litigations concerning breach of contract, fraud, employment, and lien foreclosure issues for New York City-based real estate and construction services companies.
Represented an international start-up company in the sports ticket and leisure travel industry in a dispute with a minority owner, and successfully resolved the matter without the need for litigation in the United States or in Europe.
Obtained a temporary restraining order and preliminary and permanent injunctions for an insurance brokerage company in non-competition, non-solicitation, and misappropriation of confidential information and trade secret action.
Defended an iconic performance art company in a litigation in the Supreme Court, New York County against claims of breach of contract, breach of fiduciary duty, and unjust enrichment and seeking an accounting, and successfully resolved the matter without the need for a trial.
Successfully represented a distributor of medical, dental and veterinary supplies in numerous litigations involving claims of breach of non-competition and non-solicitation agreements including the securing or opposition of applications for temporary restraining orders.
Successfully and efficiently represented a company owning numerous nursing homes in Connecticut as debtors in a voluntary bankruptcy proceeding and related litigations.
Defended two west-coast power companies in adversary proceedings and related litigation at the Federal Energy Regulatory Commission related to two-way power contracts against a large energy company, and successfully resolved the matters without the need for a trial.
Successfully and efficiently represented the unsecured creditors’ committee in a diamond-industry bankruptcy in the United States Bankruptcy Court, Southern District of New York.
